Photos Of Residents

I have just joined the ranks of a really great facility. My problem is the rule that they have there of getting a signiture from a resident each time a picture is taken. We are told that because of HIPPA, this is necessary. What are the Federal regs on this and won't one signiture upon admission be sufficient? Other facilities that I have worked at require only the one signiture. Are we being overly cautious? Residents want glamor shots done and other pics taken but the headache of the paperwork has nixed all this. Please help. Thanks in advance.

Recently I was made aware that I should keep track of the photo and outing releases and who signed and who didn't. I had kept all the forms but they weren't as organized as I would have liked :-( . I was told I could get in hot water if I didn't keep up with and follow what the forms indicated. Does everyone else do this? :-o

I'm afraid w/ all of the HIPAA regulations, you do want to keep track of that stuff. As of right now, our social worker has them sign a release upon admission. We have asked our privacy officer if this is still ok.

Thanks Stacie, but do you know who (residents) has signed the releases, in case you want someone to go on an outing or take a photo of someone during an activity? :-)

What I have done in th past is make note of the residents who did not want their photos taken. I only had about three out of sixty that did not agree. But like Stacey says due to HIPPA, I would keep up a list.

Yes, we keep a list of those who have signed the release. It is done upon admission.

We do the same thing. Upon admission the families sign a release form. We are notified is there is someone who does not want their picture taken, and I keep track of that. I do try and get a photo release, if I know of a specific event. I know that is double work, but sometimes I feel safer doing it that way. As far as outings, I talk with the families, and make note in the residents chart. I try to get an OK to go on all outings. Most families tell me take them on whatever they want. I will keep track of the families that want to be contacted for every outing that the resident signs up for.
