Copy Right?!

Recommended Posts

Hey All, I have a quick question....I use Creative Forecasting every month for activity ideas and the such. Usually my assistant and I use a blank calendar and paste a bunch of stuff onto it along with each days events to create our own calendar. Recently however I started wondering if it would be a violation of Copy right laws to just copy the calendar out of the middle of Creative Forecasting and use that (avoid spending so much time creating our own)??? This may be a dumb question because it seems as if that is the purpose for them putting that Calendar in there. I just want to make sure I would not be getting myself into trouble by using that...If anyone knows, please clue me in!!!

This Website is an amazing tool....

Thanks,

Phxville

I do not know much about the law to it all but there is a little note under the calendar that mentions copywrite. Along with that little note is an email and a telephone number. Call that number and see what they say about it. Maybe if you give credit to the source....I dont know. Let us know what you find out, please.

Thanks,

Tiff

I think it is o.k. - I would assume since they put it in there you can use it. The copyright is probably for duplication or selling rights. I think that if you buy the magazine then you have the right to use it.

But I would call - to ease your mind.

Hello!

I looked at my Creative Forecasting and found this:

" Copyright Notice

Materials may not be reproduced from Creative Forecasting except for use with your residents and in the subscibing facility newsletter. Creative Forecasting cannot be copied for any other use without our express written permission. Use discretion when using and applying these materials so you do not offend any of your readers or participants.

"Any reprinting must include this endorsement: REPRINTED WITH PERMISSION FROM CREATIVE FORECASTING, A Monthly Publication for Activity Professionals"

I hope that helps a bit. Basically, it is ok just put the above on it.

Guest Creative Forecasting

We are so greatful for the questions and help regarding Copyright issues.

The following notice is printed in every issue of “Creative Forecasting”:

“Copyright Notice: Materials may not be reproduced from Creative Forecasting except for use with your residents and in the subscribing facility newsletter. Creative Forecasting cannot be copied for any other use without our express written permission. Use discretion when using and applying these materials so that you do not offend any of your readers or participants. Any reprinting must include this endorsement: REPRINTED WITH PERMISSION FROM CREATIVE FORECASTING, A Monthly Publication for Activity Professionals.”

“Creative Forecasting“, is copyrighted by Creative Forecasting, Inc., as the copyright notice on every page of each issue clearly states. As a subscriber and / or reader of “Creative Forecasting” you have a legal obligation to respect that copyright and avoid infringing upon it.

It has been brought to our attention several occasions that “Creative Forecasting” magazine is being reproduced and redistributed by various organizations to other facilities without express permission from the publisher of “Creative Forecasting”.

On several occasions we have found that different facilities jointly pay for one subscription and reproduce and redistribute this magazine or portions of it for all the facilities. This practice is strictly forbidden under United States Copyright Law and may expose those who violate this law to serious criminal or civil penalties.

It takes hundreds of hours and substantial resources to produce each issue of “Creative Forecasting” and these production costs are part of the annual subscription fees. The cost of copyright infringement is all too obvious when these costs, as well are passed on to the subscriber.

In short, to cut through all the legalese: You are well within the intent of these copyright restrictions, copying the calendar for your facility use. The intent of “Creative Forecasting” has always been for the subscriber to maximize this resource with their clients within the confines of the subscribing facility.

We certainly appreciate your inquiry and the opportunity to respond to this issue on this forum. For questions, further clarification, or to report any Copyright violations contact Creative Forecasting at: (800) 373-0115, (719) 633-3174, Fax (719) 632-4721 or e-mail cfi@cfactive.com. Mailing address: Creative Forecasting, P.O. Box 7789, Colorado Springs, CO 80933-7789

Thank You,

Sincerely,

Rob Clagett,

Circulation Manager

Creative Forecasting Inc.
